Our Constitution guarantees everyone rights to education, but that doesn\u2019t mean parents can necessarily pick and choose which schools they send their children to. Nor does it mean that they can expect schools to continue educating their children if they don\u2019t pay the agreed fees.<\/p>\n\n\n\n

A recent High Court judgment provides a perfect example.\u00a0<\/p>\n\n\n\n

Breaking the camel\u2019s back \u2013 4 years of arrears totalling R407k<\/h6>\n\n\n\n

A father\u2019s failure to settle a bill of over R407k in unpaid school fees for his daughter\u2019s education at \u201can elite private school\u201d in Cape Town has led to him being interdicted from enrolling her there for the 2025 school year.<\/p>\n\n\n\n

The school\u2019s patience has clearly run out after years of the father\u2019s failure to stick to a payment plan, negotiated four years ago. The Court characterised his actions as a \u201cmodus operandi of non-payment and broken undertakings\u201d. His explanation, that affordability is the issue and that he could not pay the outstanding arrears, cut no ice with the Court.\u00a0<\/p>\n\n\n\n

The proverbial \u201cstraw that broke the camel\u2019s back\u201d, said the Court, was the father\u2019s \u201cflat-out refusal to sign the most recent restructuring agreement, which had been drafted in a last-ditch effort to record in writing the terms of the most recent agreement between the [school] and the [father] so that his daughter could be enrolled at the school for her next academic year.\u201d<\/p>\n\n\n\n

The child\u2019s best interests are always paramount<\/h6>\n\n\n\n

Our courts are the \u201cupper guardians\u201d of all minor children, and this Court was, as always, careful to consider the daughter\u2019s best interests.\u00a0<\/p>\n\n\n\n

Critically, she is not left without alternative educational opportunities \u2013 that would be a breach of her Constitutional rights as well as a violation of the strict warnings from our courts that\u00a0\u201cschools that provide basic education are under a constitutional duty not to diminish the right to basic education and at all times to act in the best interests of the child.\u201d\u00a0<\/strong>(Emphasis added.)\u00a0<\/p>\n\n\n\n

In this instance, the school had secured \u201can alternative good school\u201d for her \u2013 a government-subsidised school in the same suburb as her brother\u2019s school. The father\u2019s rejection of this alternative school as being \u201c\u2018unsuitable\u2019 because [it] is not predominantly white, and this does not align with his daughter\u2019s cultural values\u201d was summarily dismissed by the Court with the terse comment: \u201cThe less said about this argument, the better\u201d.<\/p>\n\n\n\n

The enrolment contract and the school\u2019s obligations\u00a0<\/h6>\n\n\n\n

This case is an important reminder that we are bound by the agreements we make. The father, in signing his daughter\u2019s enrolment contract, was aware that:<\/p>\n\n\n\n

    \n
  • The school is an independent school, getting virtually no government funding and relying on school fees and donations to fund its operations and to educate its learners.<\/li>\n\n\n\n
  • Failure to pay fees was a breach of contract which would inevitably lead to the daughter\u2019s exclusion from the school.<\/li>\n<\/ul>\n\n\n\n

    Our courts, once again putting the interests of children first, insist that\u00a0\u201cany decision to suspend or expel a learner during school term must satisfy due process. These include adequate warning prior to suspension or exclusion, provision to make arrangements to settle fees, or the opportunity to make arrangements to enrol a learner at a new school.\u201d<\/strong>\u00a0(Emphasis added.)<\/p>\n\n\n\n

    The school in this case had clearly gone \u201cabove and beyond\u201d in this regard, and the Court had no hesitation in issuing the interdict with costs payable by the father who must now enrol his daughter in another school \u2013 and pay this school its outstanding fees with interest.<\/p>\n\n\n\n
